BINSR – Buyer’s Inspection Notice and Seller’s Response form

The BINSR process is a negotiation between the Buyer and Seller and can directly affect the success of the transaction.

What is a “BINSR”?

BINSR is an acronym used by real estate professionals to refer to Arizona’s Association of Realtors Buyer’s Inspection Notice and Seller’s Response form.

Why is it used?

The BINSR is the Buyer’s opportunity to request any repairs or to address any issues regarding the property with the Seller that may have been discovered during the Inspection Period. Submission of the BINSR form will initiate a negotiation process between the Buyer and Seller culminating in the Buyer agreeing to proceed with the purchase or cancelling the contract based on disapproved items. Failure to submit the BINSR form within the specified timeline is considered agreement to proceed and may result in financial consequences.

How does it work?

The BINSR process begins with the Buyer completing and submitting the form to the Seller. There are three (3) choices when completing the form:

  1. If Buyer is satisfied with the property after completing their inspections, Buyer may Accept the property and move forward with the purchase. In this case, no Seller response is required to continue with the purchase.
  2. If Buyer has identified specific items that they disapprove of during their inspections, Buyer may reject the property and cancel the contract based on those specific items. By rejecting the property within the inspection period, the Buyer’s Earnest Money will be refunded unless extenuating circumstances exist. In this case, no Seller response is required to cancel the contract.
  3. If Buyer has identified specific items that they disapprove of during their inspections, Buyer may list the disapproved items and provide the Seller an opportunity to correct them. In this case, the Seller will evaluate the request and provide a response. If Buyer has chosen this option and provided the Seller with a list of disapproved items, the Seller will respond by completing and submitting the form back to the Buyer. The Seller has three (3) response options available to them:
    1. The Seller may agree to satisfy the requests as outlined.
    1. The Seller may refuse to satisfy the requests as outlined.
    1. The Seller may offer an alternative proposal to fully or partially satisfy the requests as outlined.
Completing the Process

The last response and final decision of how to complete the BINSR process remains with the Buyer.

  1. Buyer may elect to cancel the contract and the Buyer’s Earnest Money will be refunded unless extenuating circumstances exist.
  2. Buyer may accept the Seller’s response and move forward with the purchase.
